NAFTA and Water

Water is defined as a “tradeable good,” “service” and “investment” in NAFTA.

As a tradeable good, NAFTA dramatically limits the federal government’s ability to stop provinces from selling water. If a provincial government decides to sell water to parched U.S. states, the federal government would be powerless to turn off the tap. And NAFTA’s proportionality clause would mean the province couldn’t cut back on the amount of water it was sending to the U.S. even in times of drought.

Removing water as a “service” would help protect water as an essential public service. When services are provided by private corporations, NAFTA provisions limit the involvement of the public sector. NAFTA’s negative list approach means that unless a service is specifically exempted, it must be opened up to the private sector. Examples around the world have shown the impacts privatization has on water services, including increased rates, reduced accessibility and poorer quality.

Removing water as an “investment” and excluding NAFTA’s ISDS provisions would make it much harder for foreign corporations to use trade treaties to fight domestic or international rules that protect water. Canada has already been sued for millions of dollars for laws protecting water.

Call on Prime Minister Trudeau and the Canadian government to strengthen water protections in NAFTA and stop companies from profiting from water (Trudeau must stand up to Trump during NAFTA talks ):

And he argues it’s in breach of the Bribery Act.

Condemnation

May’s decision to prop up her weakened no-majority government with a £1.5bn deal with the DUP – including £1bn of new money – has received heavy criticism. Scottish First Minister Nicola Sturgeon called it a “grubby, shameless” deal. While Welsh First Minister Carwyn Jones said it was a “straight bung”. Labour’s Dennis Skinner has also called the arrangement a “protection racket”.
Now a Green Party member, who unsuccessfully stood for the party in the June election, has decided to bring a legal challenge against it. McClean said:

I have spent most of my life campaigning for peace in Northern Ireland. The deal concluded between the government and the DUP threatens everything we’ve worked so hard for and I’m bringing this case to ensure the government is held to account.

The mental health worker is attempting to crowdfund: https://www.crowdjustice.com/case/challenge-dup-deal/ the legal action. The campaign has raised over £18,000 at the time of writing. Solicitor David Greene is taking up the case. The partner at Edwin Coe solicitors previously represented Deir Tozetti Dos Santos, one of the successful lead claimants in the Article 50 challenge in the Supreme Court. On his crowdfunding page, McClean said of the deal:

It’s straight bribery – money for votes.
My claim is that as a citizen I expect my Government to honour its obligations under the Good Friday Agreement and not to bribe others with money so that it can stay in power.


Legal test

McClean’s legal team plans to issue high court proceedings in the coming week.
It has already had contact with the government over the matter. But McClean says the government’s response failed to address the “fundamental issues behind this corrupt deal”.

A former government lawyer and Tory MP, Alberto Costa, claims the deal was “transparent and lawful” and that the bribery accusation is “spurious”. He also added that it was “vexatious”.

And the challenge is no doubt “vexatious” for the Tory Party. Numerous people have characterised the deal as a bribe. And over 750,000 members of the public signed a petition on the controversial move, which described it as a “disgusting, desperate attempt to stay in power”. Now the courts will get to determine whether the deal is above board by their specific standards.

But to use a favoured phrase of Tory politicians: “if you have nothing to hide, you have nothing to fear ”. And the government insists the deal isn’t a cash-for-votes bribe. So it can just sit back, calmly as our democratic, rule of law system does its work.

HAMBURG, GERMANY—Prime Minister Justin Trudeau says an apology and reported $10.5-million compensation payment to former Guantanamo Bay inmate Omar Khadr was a basic matter of following Canada’s Charter of Rights and Freedoms.

The settlement is not about the details of Khadr’s case but the fact his rights were violated, Trudeau said.

“The Charter of Rights and Freedoms protects all Canadians, every one of us, even when it is uncomfortable,” he said. “When the government violates any Canadian’s charter rights, we all end up paying for it.”

The prime minister made his brief comments in answering a question at the closing press conference following the G20 leaders summit in Hamburg.

The settlement resolves a long-standing lawsuit in which Khadr claimed Canada had violated his rights and was complicit with the United States when he was detained at the U.S. base in Guantanamo, Cuba denied access to a lawyer and tortured. Khadr was seeking $20 million in damages.

The Supreme Court of Canada in 2010 ruled Khadr’s rights had been violated.

The apology and payout sparked fresh public debate about Khadr. Conservative Leader Andrew Scheer decried the settlement as “disgusting,” saying Khadr’s return to Canada should have been remedy enough.




“Justin Trudeau should never have agreed to a secret deal that gave a convicted terrorist millions of dollars,” Scheer said.

An online petition by the Canadian Taxpayers Federation calling on the Trudeau government to revoke Khadr’s multimillion dollar payout received more than 52,000 signatures in two days.

In an interview on Friday, Khadr lamented the “political circus” his case has created, and said he hopes the settlement would allow him and Canadians to move on.

“I’m not celebrating it. It’s a time for reconciliation and I hope that this chapter is closed,” he said.

In 2010, while in the Guantanamo Bay military prison, Khadr pleaded guilty in exchange for a chance to serve his sentence in Canada. Once released, he told the Star he was not certain whether he threw the grenade that killed U.S. Delta Force soldier Sgt. Christopher Speer, but took the Pentagon plea deal as he believed it was his only way to leave the U.S. prison in Cuba.

He is appealing the conviction in a Washington court.
