4.2 A copy of a record made at the time must be

given immediately to the person who has been

searched.The officer must ask for the name,

address and date of birth of the person searched,

but there is no obligation on a person to provide

these details and no power of detention if the

person is unwilling to do so.

(67) 15. No person shall be convicted of an offence in respect of an act or omission in obedience to the laws for the time being made and enforced by persons in de facto possession of the sovereign power in and over the place where the act or omission occurs. [R.S., c.C-34, s.15.]
