Energy Transfer Partners is refusing to stand down on its construction plans despite two requests from
the U.S. Army Corps of Engineers that it do so.


The company, builders of the Dakota Access Pipeline (DAPL), said on Tuesday November 8 that it planned to begin drilling in two weeks—

even though at the moment it does not have the easements necessary for it to tunnel under the river legally.

Building without approved easements is a violation of federal law,
the Army Corps emphasized.


"Any work must adhere to federal regulations,the Army Corps said. “Failure to comply can bring (should bring) legal action.
Construction without proper permits or easements in place can result in (should result in) fines and legal action.
"



And I wonder if a no-fly zone order is in effect, HOW ARE the Water Protectors, the Activists who joined them and the Vets going
TO VERIFY IF the company building the Dakota Access Pipeline (DAPL) has really, truly stopped their action TO drill under
Lake Oahe?

Oil Company Openly States They Will Defy Army Corps Order in Standing Rock

According to a statement from Energy Transfer Partners and Sunoco Logistics, which is acquiring ETP in a merger:

“As stated all along, ETP and SXL are fully committed to ensuring that this vital project is brought to completion and fully expect to complete construction of the pipeline without any additional rerouting in and around Lake Oahe. Nothing this Administration has done today changes that in any way.”

Oil Pipeline Shut Down After Spill, Just 200 Miles From Standing Rock

A six-inch crude oil pipeline operated by Belle Fourche Pipeline Company in western North Dakota was shut down following discovery of a leak on Monday. The amount of the spill was not immediately known, but oil has leaked into the Ash Coulee Creek in Billings County.

The site of the spill is about 200 miles from the camp where members of the Standing Rock Sioux Tribe and their supporters have been protesting the construction of the Dakota Access Pipeline.

"It is a significant spill," Bill Suess, spill investigation program manager for the North Dakota Department of health, said.

"A series of booms have been placed across the creek to prevent downstream migration and a siphon dam has been constructed four miles downstream of the release point."

The Belle Fourche Pipeline Co. is part of the family-owned True companies, which also operates Bridger Pipeline LLC. Both pipelines are operated from the same control room in Casper, Wyoming. From 2006 to 2014, Belle Fourche reported 21 incidents, leaking a total of 272,832 gallons of oil. Bridger Pipeline recorded nine pipeline incidents in the same period, spilling nearly 11,000 gallons of crude.

"In general, Bridger has a poor compliance history," wrote a federal regulator charged with overseeing pipeline safety in a 2012 order regarding a 2006 oil spill.

A Belle Fourche pipeline that spilled 12,200 gallons in May, 2014 occurred on Bureau of Land Management (BLM) land near Buffalo, Wyoming. It was later discovered that Belle Fourche did not have a permit to operate the land. Its sister company, Bridger, was fined $27,029 for trespassing by the BLM.

Bridger was also responsbile for dumping up to 50,000 gallons of crude into the scenic Yellowstone River in 2015.

While operators claim that oil pipelines are safer than trains or trucks, an aging infrastructure and inadequate oversight leads to numerous leaks, most of which never make headlines. A Nov. 30 analysis by Citylab revealed that more than 9,000 significant accidents over the past 20 years have resulted in 548 deaths, 2,576 injuries and more than $8.5 billion in financial damages. An Oct. 25 analysis by EcoWatch found 220 significant pipeline spills to date in 2016 and showed that the number of significant pipeline incidents has grown 26.8 percent from 2006 to 2015.

The Belle Fourche and Bridger pipelines transport crude oil in the Williston Basin of western North Dakota and eastern Montana and the Powder River Basin of Wyoming.

Well, one thing has changed- it is NOW AN ORDER from the Obama Administration to halt the construction of pipeline, given through the Army Corps of Engineers.

The easement...The permit...The permission to continue drilling under Lake Oahe is what the company building the Dakota Access Pipeline (DAPL) was waiting for and the Obama Administration quite simply DENIDE giving said easement (permit).

A transition spokesman said President-elect Donald Trump will review the Dakota Access Pipeline when he takes office. On Sunday the Army Corps of Engineers rejected part of the pipeline route that would have crossed near the Standing Rock Sioux Reservation.

Protesters gathered in the middle of a snowstorm Monday carrying on their normal routine despite Sunday’s decision, reports CBS News correspondent Omar Villafranca.

With the pipeline’s future uncertain, Standing Rock Sioux Chairman Dave Archambault II is urging those braving winter conditions to leave the North Dakota camp.

“I understand the fear that they have that this is just a small victory and it’s not over yet. But it’s over right now,” Archambault said.

Mr. Trump supports the Dakota Access Pipeline and is expected to review the project after the inauguration.

“I need to find a way to reach Donald Trump to help them realize and understand what decision was made and why it’s the right decision,” Archambault said. “We are the first occupants of this nation. We were here first. We are still here and we’re not going away. And we’re not opposed to economic development. We’re not opposed to energy independence. We’re not opposed to national security. What we’re doing is we’re saying don’t make us pay for it again.”

Energy Transfer Partners, the Dallas-based company behind the pipeline, is vowing to complete the project – with its proposed Missouri River crossing about a mile upstream from the tribe’s reservation. In a statement released after Sunday’s decision, the company took aim at the Obama administration saying it “intended to delay a decision in this matter until President Obama is out of office.”

White House Press Secretary Josh Earnest answered questions about the denied easement Monday.

“The White House did not and has not been dictating the outcome but rather has been updated by the Army Corps on the negotiations,” Earnest said.

“If the decision changes, do you expect to see people out there protesting again?” Villafranca asked Archambault.

“I don’t think it’s necessary. We won, and we have to continue moving forward and trying to work with…the Trump administration and to make this decision stick,” he responded.

With a large contingent of Drones at their disposal they can use the same kind-of idea that they use in the Canadian North to relay pertinent information to who ever they choose...
