Thomas Linzey & Mari Margil: Occupy the Law | Bioneers 2016

Published on Dec 1, 2016

Thomas Linzey & Mari Margil - Occupy the Law: The Movement for Community Rights and the Rights of Nature.

As species collapse around the world while governments still authorize fossil fuel extraction and other destructive, unsustainable activities, communities across the U.S. are rising in resistance to "occupy the law". They're enacting "community bills of rights" that recognize a community's legally enforceable right to sustainability and the rights of nature.

Two of its most effective path-finding national and global leaders,
Tom Linzey and Mari Margil of the Community Environmental Legal Defense Fund,

show how this movement challenges America`s constitutional framework in which corporate rights and the preemptive authority of state and federal governments block sustainability, environmental protection and democracy.

I personally recommend that Cenk Uygur And/or that Kyle Kulinski should interview either Tom Linzey or Mari Margil or both about the Community Environmental Legal Defense Fund...I believe that it will be very illuminating for all.

Thomas Linzey: Legal Community Rights To Stop Corporate Exploitation
With Sherri & Gillian

Friday, July 22nd, 2016

Thomas Linzey, is the Executive Director and founder of The Community Environmental Legal Defense Fund (CELDF) serving as chief legal counsel .

Thomas grew up in a family of environmentalists and trained as an Environmental Lawyer. He and his fellow students quickly realized that the corporations had too much power to exploit the planet without caring for its health and welfare.

Thomas Linzey and CELDF have focused on dismantling this power via Rights based legal instruments, such as Community Rights, Environmental Rights, ones right to
clean air, pure water, and healthy soil.

CELDFs objective is to help people in communities’ research environmental laws and to understand how to use the EPA and Rights to dismantle corporate power.

Just like the civil rights movement had the Highlander Institute in Tennesseeattended by Rosa Parks and Martin Luther King, Jr., – the new community rights movement has the Democracy School.

Pipeline's "Eminent Domain" Land Seizure Angers Iowa Farmers

Dakota Access, LLC Crude Oil Pipeline Project Iowa Informational Meetings:

Published on Jan 4, 2017

This is part 1 of a series that will be presented in the order in which it was shot, starting with this, the drive from Des Moines out to Iowa farm country.

Bold Iowa director and former state legislator Ed Fallon introduced TYT's Eric Byler ( Twitter.com/EricByler ) to several Iowa land owners who had their property taken away through an unusual type of eminent domain, where the state government gives to an out-of-state corporation the right to decide whose property to take for the "public good. "

The land was returned to them after the pipeline was put in the ground, but many farmers found that the land soil was damaged and that pieces of metal had been left behind.

Why Did Iowa Give DAPL the Right to Take People's Land?

Published on Jan 5, 2017

The right to take private land for public use, known as eminent domain, is something most Americans assume is reserved for governments that are accountable to the People. But in Iowa, the state government, led by Trump appointee and Iowa governor Terry Branstad (R), granted Energy Transfer Partners the right to seize public land for the construction of the Iowa segment of the Dakota Access Pipeline.

How and why did this happen?

This is part 3 of a series:

Iowa Woman Arrested for
Fighting Dakota Access Pipeline

I (verynewtothis) also stated previously multiple times at this THREAD LINK http://worldfreemansociety.ca/forum/vntt-study-notes/116058-standing-rock-the-dakota-access-pipeline-protests?start=150 that:

I see good times ahead for DAPL ...
I don't see them laughing...

Published on Jan 28, 2017

Iowa's segment of the DAPL is in the ground now, but a court challenge could prevent anything from being pumped through it.
Kathy Holdefer of Jasper County, IA, who was arrested during a civil disobedience protest against the pipeline, explains the state law restricting the use of eminent domain that undergirds their case.

Kathy also shares with TYT's Eric Byler ( Twitter.com/EricByler ) how she felt about the construction process, which went on day and night and, she felt, endangered her granddaughter. And, she called out Gov. Terry Brandstad (R) for arranging for the right of eminent domain to be transferred to an out-of-state oil transfer corporation.

Energy Transfer Partners threatened to take her land and then ended up taking the land of her neighbors.

The Protection of Boulder County (Full Length): Fracking and Community Defense

Published on Dec 4, 2016

Presenters: Merrily Mazza, Cliff Willmeng, Thomas Lindsey

Over four years, communities across Colorado have engaged with government to defend the land from the inherently dangerous practice of hydraulic fracturing.

Every legal remedy was thoughtfully utilized to protect the environment and our families, which ranged from statements to our local officials to lobbying the state government to community ballot initiatives postponing or banning drilling where we live. The response from the state and industry was powerful and determined. Through laws and court rulings we were informed that our rights, the rights of our environment and the well being of our communities are not a consideration when it comes to the interests of the oil and gas industry.

With the understanding that we have the historic duty to protect the land and the people for generations to come,
the Boulder County Protectors will be conducting an introductory training on the ideas and methods of nonviolent direct action. Drawing from the history of this method, we will begin the conversation of what a campaign to defend Boulder County from drilling would look like. We will combine presentation, discussion and exercises to introduce people to the powerful history and methods of direct action and civil disobedience where it could be used to defend Boulder County.

The Protection of Boulder County (Part 1): Prepared To Do A New Kind Of Activism -- Or Get Fracked?

"The fact is the regulatory system isn't broken, it's working perfectly. It was never intended to protect health, safety and welfare. It was intended to be a barrier between you and your own governmental system. It's intended to legalize harms."

(Part 2): State-Mandated Fracking Via Dillon's Rule

Dillon's Rule, is terrifying legal doctrine used by the corporate-state to force corporate harms such as fracking upon people, their communities and nature.

We the People of Boulder County stand for our inalienable right to local self-government for protecting the rights of people, communities and nature to health, safety, welfare, sustainability and climate.

(Part 3): Peemption & Dillon's Rule Violate Your Rights

How do Preemption and Dillon's Rule -- 100 year old legal doctrines -- disempower Boulder County from legally protecting its people, communities and nature from corporate harms like fracking?

As Boulder County's commissioners terminate their fracking moratorium and prepare to sign new fracking permits,
Thomas Linzey of the Community Environmental Legal Defense Fund explains how our county has no further legal options for stopping the harm.

(Part 4): Fracking Via Corporate Rights

Banning fracking in Boulder County and massive direct action enforcement of that ban by the people of Boulder County is essential to protect our people, communities and nature.

Corporate rights is one of 4 legal doctrines Frackers will use to "recover lost profits" from prohibited wells.

(Part 5): About To Be Drilled? What are Your Going To Do About It?

Boulder County Fracking moratorium extensions postpone drilling and therefore violate fundamental, inalienable rights of our people, communities and nature for clean water, earth and air; to sustainability and climate; for the right of nature to exist and flourish .

Thomas Linzey give two examples of what other communities are doing to protect from such corporate harms.

So from what I have seen and read so far, Americans Aren`t As FREE As They And a LOT OF People Around The WORLD THINK They Are ...

Buried memo from Interior Department's top lawyer surfaces in legal filings:
The 35-page formal legal opinion, dated Dec. 4, found that the existing environmental assessment for the Dakota Access pipeline suffered from fatal flaws. The Trump administration quietly suspended the opinion as it prepared to approve the pipeline. "It's hugely significant," said Earthjustice Attorney Jan Hasselman, who is representing the Standing Rock Sioux Tribe in their lawsuit against the Corps. Of the Trump administration's attempts to bury the memo, he said, "The Standing Rock Sioux deserve better. That's why we have courts."

Read more:

From Standing Rock Sioux Tribe
Setting The Record Straight.

On Feb. 23, the Tribe issued a report on engagement on the Dakota Access Pipeline.
Selected excerpts from Setting The Record Straight:

The Tribe was fully engaged from the beginning. The Tribe contacted the Army Corps, even before DAPL applied for permits, to express its deep concerns about the pipeline in this location and its effect on the Tribe’s treaty rights and cultural sites. (The full story: http://earthjustice.org/sites/default/files/files/Memo-ISO-SRSTs-Mtn-for-PSJ.pdf ) In September 2014, the Tribe made its overwhelming objection to the proposal clear to DAPL representatives, and promised to fight them if they proceeded in the proposed location. A recording of what was said:

Standing Rock Sioux Tribe Elder
Phyllis Young Speaks Truth To Power

(Transcript: http://earthjustice.org/sites/default/files/files/Ex6-J-Hasselman-Decl.pdf )

The Corps did not hold 389 meetings with Tribes. A significant portion of that '389' number were requests from Tribes to the Corps seeking information about the proposed pipeline and the Corps’ process for reviewing it, raising concerns and objections, and requesting meetings to discuss those concerns—many of which were ignored by the Corps.

The Tribe participated fully in the NEPA (the NATIONAL ENVIRONMENTAL POLICY ACT: https://www.blm.gov/or/regulations/files/nepa25fn.pdf ) process. The Tribe submitted three lengthy sets of technical and legal comments on the December 2015 draft EA, comprising hundreds of pages, raising objections and seeking better analysis of spill risks and the Tribe’s treaty rights.

The Tribe sought to protect its rights when no one else would. The Tribe refused to get out of DAPL’s way and allow them to do something the Tribe thought was illegal and immoral. Neither the Corps nor DAPL ever explained why, if the pipeline was so safe, they didn’t select the alternative route and cross the Missouri River north of Bismarck where the river is narrower.

The Corps relied on flawed, one-sided analysis prepared by DAPL—and never subjected to any independent review—minimizing the risks of oil spill, and ignored the Tribe’s treaty rights to water, fishing, and hunting. In December 2016, the Corps correctly found that those issues needed further consideration through an EIS process. On his second full day in office, the Trump administration overruled the Corps and ordered the permits to be granted. Standing Rock Chairman Archambault was on his way to meet with the White House when the easement was issued—no one from the Trump administration ever talked to a representative of the Tribe before ordering the project to go forward.

The new administration failed to engage in good faith in the process.

Update: February 14, 2017, 1:30PM PT

Standing Rock Sioux Tribe Asks Federal Court To Set Aside Trump’s Pipeline Reversal; Critical Motion Charges Trump Administration Circumvents Law And Ignores Treaty Rights.

Today, on behalf of the Standing Rock Sioux Tribe, Earthjustice filed a motion for summary judgment: http://earthjustice.org/sites/default/files/files/Memo-ISO-SRSTs-Mtn-for-PSJ.pdf on the major legal claims in the lawsuit filed against the U.S. Army Corps of Engineers to prevent the construction of the Dakota Access Pipeline under Lake Oahe near tribal lands. The motion for summary judgment asks the judge to rule on major legal questions that have not yet been resolved during this case, including whether National Environmental Policy Act requirements have been met and whether the Corps’ actions violate the tribe’s treaty rights.

The judge appears ready to move forward on this case on an expedited basis, which is vital since attorneys for the Dakota Access Pipeline now say construction could be completed much sooner than they originally told the court. Dakota Access has been ordered to reply to our motion within three weeks.

“President Trump claims he has not received ‘a single phone call: https://www.facebook.com/permalink.php?story_fbid=1536971589664439&id=402298239798452 ' opposing this widely criticized project,” said Dave Archambault II, chairman of the Standing Rock Sioux Tribe. “Millions of people have raised their voices against this dangerous project.”

On Feb. 8, the Trump Administration granted an easement: http://www.nwo.usace.army.mil/Media/News-Releases/Article/1077134/corps-grants-easement-to-dakota-access-llc/ allowing the pipeline to be constructed under the Missouri River half a mile upstream of the Standing Rock Sioux Reservation. It reverses an earlier decision by the Corps to withhold the easement: http://earthjustice.org/sites/default/files/files/stmt.pdf while the agency completed an environmental review: https://www.federalregister.gov/documents/2017/01/18/2017-00937/notice-of-intent-to-prepare-an-environmental-impact-statement-in-connection-with-dakota-access-llcs of alternate pipeline routes and the Tribe’s treaty rights.
The environmental review, referred to as an environmental impact statement,
has been wrongfully terminated mid-process

The lawsuit challenges the Corps’ hasty and unexplained departure from its previous decision, and explains how the Corps ignored the Tribe’s treaty rights and seeks to destroy culturally significant and sacred sites. It also explains how the Corps violated federal statutes requiring close environmental analysis of significant and controversial agency actions.

“In this arbitrary and capricious reversal of course, the Trump Administration is circumventing the law: wholly disregarding the treaty rights of the Standing Rock Sioux and ignoring the legally required environmental review. It isn't the 1800s anymore—the U.S. government must keep its promises to the Standing Rock Sioux and reject rather than embrace dangerous projects that undercut Treaties,” said Jan Hasselman, the Earthjustice attorney who is representing the Tribe in its challenges against the pipeline.
